Smith's PC Consulting Web Hosting Divison - Terms of Service

Limitations of Liability :

In no event shall Smith's PC Consulting, Web Hosting Division, be liable for damage resulting from loss of data, profits, or for any incidental or consequential damages, even if advised of the possibilities of such damages. You agree to indemnify and hold Smith's PC Consulting harmless from any and all claims, losses, damages, liabilities, judgments, or settlements, including reasonable attorneys fees, costs, and other expenses incurred by us as a result of any activities conducted by our users.

Unsoliticited Bulk Commercial Email / SPAM :

Unsolicited Bulk Commercial Email also commonly known as SPAM is strictly forbidden on all the servers hosted on our network. Any user found to be sending SPAM will be warned and will be given a 24 hour notice period. This period must be utilized to clear up any SPAM problems emanating from his/her server. If within 24 hours the SPAM issue isn't resolved, our service to the user will be subject to immediate termination without liability and refunds. All subscribers must also ensure that their SMTP servers do not have an open relay. Smith's PC Consulting is not liable for SPAM sent out by its clients although we will do what's most possible to prevent SPAM from its users. If a user is found to be deliberately sending SPAM through the network, a fine of $500 per incident will be imposed on the user. After 2 such incidents, the user will be permanently removed from our network.

Network Abuse :

Smith's PC Consulting forbids any form of network abuse including but not limited to "denial of service" attacks. Any form of bandwidth abuse, IP abuse or network abuse will not be tolerated. Any user generating any form of abuse will be subject to a 24 hour notice period, this period must be used to clear up any abuse problems emanating from his/her server. If within this period the abuse problems are not resolved, the user will be subject to immediate termination of service without liability or refunds. If a user is found to be deliberately using the network to perform network attacks, a fine of $500 per incident will be imposed on the user. After 2 such incidents, the user will be permanently removed from our network.

Content :

Smith's PC Consulting does not allow any 'adult' or pornographic content on our servers. We also will not tolerate storage any forms of 'illegal' content or copyrighted material. Any sites found with such files will be taken offline immediately and their accounts closed without liability of refunds.

Termination of Account :

Smith's PC Consulting reserves the right to terminate or suspend any account with or without reason. Before we terminate an account, a 24 hour written notice will be given to the account holder via email. Similarly, subscribers who wish to cancel our services may do so at any time. The user will not be billed the following period but no refunds will be given for unused services between the time of termination and the next billing period.

Important Notes : We reserve the right to alter this document at any time without notice. If major changes are involved, the account holder will be notified and given the opportunity to accept or reject the revised terms. Smith's PC Consulting will be the sole judge of what constitutes a breach of the Terms of Service as detailed on this page.
